Town worker who retired at 42 to get benefits, $20K in age discrimination suit

PENNSVILLE TWP. -- A former township employee has received a $20,000 settlement and retirement benefits after suing Pennsville for age discrimination.

Keith Lamb had worked for the Pennsville from Dec. 12, 1994 through May 1, 2015 until retiring with his most recent job as a supervisor with the water department.

He claimed in a civil lawsuit filed against the Township of Pennsville in April 2016 that when he retired at age 42 the township failed to give him the medical and life insurance coverage he was entitled to and payment for the 35 days of unused sick time he had accumulated.

In his suit, Lamb said he filed a grievance with the township over not receiving his benefits in February 2016, but the township did not respond.

Lamb claimed all of the benefits he was seeking are guaranteed employees under township ordinances.

" ... the Township of Pennsville unlawfully discriminated against (Lamb) because of his age and years of service with the Township," his suit said. Pennsvillle "breached its employment agreement with plaintiff by failing to provide the benefits enumerated in its Township ordinance."

The refusal of the township to provide the benefits he earned "violate New Jersey's law against discrimination," the suit said.

In the suit, Lamb had sought "compensatory and ounitive damges, interest, attorney's fees and cost of suit."

In the agreement signed April 24, along with the $20,000, Lamb's retirement benefits were reinstated.

Both sides also agreed to not make disparaging remarks about the other related to the case and settlement of the claim is "not an admission of liability, but is made for the purpose of terminating all disputes and litigation between the parties ..." the signed settlement agreement says.
